Welcome to ThyHearts.
These Terms and Conditions (“Terms”) govern your access to and use of thyhearts.com (the “Site”) and any purchase you make from ThyHearts (“ThyHearts,” “we,” “us,” or “our”).
By accessing the Site or placing an order, you agree to these Terms, our Privacy Policy, and our Shipping & Returns Policy. If you do not agree, please do not use the Site.

1. ELIGIBILITY

You must be at least the age of majority in your place of residence or have the permission and supervision of a parent or legal guardian to use the Site or make a purchase.
You may use the Site only for lawful, personal, and non-commercial purposes. Products purchased from ThyHearts may not be resold or commercially distributed without our prior written authorization.

2. OUR ONLINE STORE

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer and sell our products.
Purchases made through the Site are transactions directly between you and ThyHearts. Shopify is not the seller of ThyHearts products and is not responsible for the products, fulfillment, returns, or customer service relating to your order.

3. PRODUCTS AND AVAILABILITY

We make reasonable efforts to display our products, descriptions, fragrance notes, sizes, packaging, and colors as accurately as possible. However, the appearance of products may vary depending on your screen, device settings, lighting, production variation, or packaging updates.
Fragrance is personal, and individual perception, skin chemistry, and wear may affect how a scent is experienced. Product descriptions and fragrance notes are provided for general reference and do not guarantee how a fragrance will smell or perform on a particular person.
All products are subject to availability. We may limit quantities, discontinue products, or modify packaging, presentation, descriptions, or availability at any time without prior notice.

4. ORDERS AND ORDER ACCEPTANCE

Submitting an order does not guarantee its acceptance. After an order is placed, you will receive an electronic confirmation acknowledging that we received it.
We reserve the right to refuse, limit, or cancel an order for reasons including:

  • Product unavailability
  • Pricing or product-information errors
  • Suspected fraud or unauthorized activity
  • Payment authorization failure
  • Shipping or carrier restrictions
  • Orders that appear intended for unauthorized resale
  • Violations of these Terms

If we cancel an order after payment has been collected, we will issue a refund to the original payment method for the canceled amount.
Please review your billing, shipping, and contact information carefully before submitting an order. Contact us promptly if you discover an error. We cannot guarantee that an address or order can be changed after fulfillment has begun.

5. PRICING AND PAYMENT

Unless otherwise stated, prices on the Site are displayed in U.S. dollars.
Prices, promotions, and product availability may change without notice. The price charged will be the price displayed at checkout when the order is submitted, subject to correction of obvious errors.
Full payment is collected at checkout. You represent that you are authorized to use the payment method provided and that all payment information is accurate and complete.
Applicable taxes, shipping charges, duties, and import fees will be displayed at checkout when supported. If duties, taxes, brokerage charges, or other import fees are not collected at checkout, the recipient may be responsible for paying them as required by the destination country.

6. DISCOUNTS AND PROMOTIONS

Discount codes and promotional offers are subject to their stated terms, availability, and expiration dates.
Unless expressly stated otherwise:

  • Discounts cannot be combined
  • Discounts cannot be applied retroactively
  • Promotional offers have no cash value
  • An offer may be limited or withdrawn where permitted by law
  • A discount does not apply to taxes, duties, or shipping charges

We reserve the right to refuse or cancel the unauthorized, fraudulent, or abusive use of a promotion.

7. SHIPPING AND DELIVERY

Shipping destinations, exclusions, estimated delivery timeframes, and related conditions are described in our Shipping & Returns Policy.
Delivery dates and transit times are estimates, not guarantees. Delays may occur because of carrier operations, weather, holidays, customs processing, address issues, dangerous-goods restrictions, or circumstances beyond our reasonable control.
Once an order ships, we will send a shipping confirmation containing available tracking information.
If we cannot ship an order within the timeframe communicated at purchase, we will provide the notice and options required by applicable law.

8. CANCELLATIONS, RETURNS, AND REFUNDS

If you wish to cancel an order, contact contact@thyhearts.com as soon as possible with your order number. We will make reasonable efforts to accommodate the request before fulfillment begins, but cancellation cannot be guaranteed once an order has entered processing or shipped.
All ThyHearts purchases are final sale and are not eligible for return or exchange once delivered, except where required by applicable law or where an item arrives incorrect, damaged, or defective.
We do not accept returns based on scent preference. Please review the fragrance notes and product description carefully before ordering.
Claims involving an incorrect, damaged, or defective item must be submitted according to the process and timeframe stated in our Shipping & Returns Policy.
Nothing in these Terms limits any non-waivable consumer rights available under applicable law.

9. PRODUCT USE AND SAFETY

ThyHearts fragrances are intended for external use only.
When using our products:

  • Follow all directions and warnings provided with the product
  • Avoid contact with the eyes
  • Do not ingest
  • Keep out of reach of children
  • Keep away from heat, sparks, and open flame
  • Discontinue use if irritation or an adverse reaction occurs

Product information on the Site is not medical advice and is not intended to diagnose, treat, cure, or prevent any condition. If you have allergies, sensitivities, or medical concerns, consult an appropriate healthcare professional before use.

10. ACCURACY OF SITE INFORMATION

We make reasonable efforts to keep Site information accurate and current. Occasionally, information may contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, availability, shipping charges, or delivery estimates.
We may correct errors and update information at any time. If an error affects an order already placed, we will contact you and provide any options required by applicable law.

11. INTELLECTUAL PROPERTY

All content on the Site—including trademarks, logos, product names, fragrance names, photographs, graphics, artwork, text, videos, designs, packaging, and Site layout—is owned by or licensed to ThyHearts and is protected by applicable intellectual-property laws.
You may access and use the Site for personal, non-commercial purposes only.
Without our prior written permission, you may not:

  • Copy, reproduce, republish, distribute, or commercially exploit Site content
  • Modify or create derivative works from Site content
  • Use ThyHearts trademarks, logos, imagery, or product names in a misleading manner
  • Remove copyright, trademark, or proprietary notices
  • Use automated tools to scrape, extract, or reproduce Site content

No license or ownership right is transferred to you through your use of the Site.

12. PROHIBITED USES

You may not use the Site:

  • For unlawful, fraudulent, deceptive, or abusive purposes
  • To violate another person’s rights
  • To transmit malicious code or interfere with Site security
  • To collect or track another person’s information without authorization

We may suspend or terminate access to the Site if we reasonably believe these Terms have been violated.

We do not control and are not responsible for third-party content, availability, security, products, or privacy practices. Your use of a third-party service may be subject to that party’s own terms and privacy policy.

By using the Site, you acknowledge that information may be processed by Shopify and other service providers necessary to operate the store, process payments, fulfill orders, prevent fraud, and provide customer support.

15. FEEDBACK AND SUBMISSIONS

If you voluntarily send us feedback, suggestions, reviews, photographs, or other materials, you represent that you have the right to provide them and that they do not violate another person’s rights.
Unless otherwise agreed in writing, you grant ThyHearts a non-exclusive, worldwide, royalty-free license to use feedback submitted specifically for business improvement. We will request separate permission before using identifiable customer photographs or testimonials in public marketing, unless you submitted them under terms that already permit such use.

16. SITE AVAILABILITY AND DISCLAIMER

We aim to provide a secure and reliable Site, but we do not guarantee that the Site will always be uninterrupted, error-free, or available.
To the fullest extent permitted by applicable law, the Site and its content are provided on an “as available” basis. We disclaim warranties relating specifically to Site availability, accuracy, compatibility, and freedom from technical errors, except where such warranties cannot legally be excluded.
This section does not exclude any express product warranty we provide or any statutory warranty or consumer right that cannot be waived.

17. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, ThyHearts will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products.
Where liability cannot be excluded, our aggregate liability relating to a purchase will not exceed the amount you paid for the product giving rise to the claim, except where applicable law requires otherwise.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, or personal injury caused by negligence where such liability cannot be excluded.

18. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold ThyHearts harmless from third-party claims, losses, or reasonable expenses arising from your unlawful use of the Site, your violation of these Terms, or your infringement of another party’s rights.
This obligation does not apply to claims caused by ThyHearts’ own unlawful conduct, negligence, or breach of these Terms.

19. EVENTS BEYOND OUR CONTROL

We will not be responsible for a delay or failure caused by circumstances beyond our reasonable control, including natural disasters, severe weather, carrier interruption, customs delays, labor disputes, transportation restrictions, government action, network failure, or interruption of essential services.
This section does not affect any refund, cancellation, or other right that applicable law requires us to provide.

20. SEVERABILITY AND WAIVER

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will remain in effect.
A delay or failure by ThyHearts to enforce a provision does not waive our right to enforce it later.

21. GOVERNING LAW

These Terms are governed by the laws of the State of New York and applicable United States federal law, without regard to conflict-of-law principles.
If you reside in a jurisdiction that provides mandatory consumer protections, you retain the rights and remedies that cannot legally be waived, and nothing in these Terms restricts your right to bring a claim in a forum available to you under applicable law.

22. CHANGES TO THESE TERMS

We may update these Terms to reflect changes to our business, products, services, or legal obligations.
The revised Terms will be posted on this page with an updated revision date. Changes will apply prospectively unless applicable law requires otherwise.
